Sales Agent
A real estate sales agent is a license holder authorized to act as an agent of their sponsoring broker. In Texas, all business relationships and contracts are technically owned by the sponsoring broker, not the individual sales agent.
Texas-Specific Nuance & Citation
According to TRELA §1101.351, a licensed sales agent may not conduct real estate transactions unless they are associated with or sponsored by an active licensed broker. A sales agent is prohibited from receiving compensation or commissions directly from any party other than their sponsoring broker.
The Trap
Students often think a sales agent can accept a referral fee or bonus directly from a builder or a grateful client. Under TRELA, this is strictly prohibited. All funds must be routed through the agent’s sponsoring broker first.
Worked Example
A sales agent in Garland helps a client buy a brand-new home. The builder offers a $1,000 “agent bonus” at closing. The closing title company cannot write a check directly to the sales agent. Instead, the bonus must be paid to the sponsoring broker, who then pays the sales agent according to their commission split.
