Texas-Specific Nuance & Citation
According to TRELA §1101.051, the commission consists of 9 members appointed by the Governor with the advice and consent of the Senate. Six members must be active licensed brokers with at least 5 years of experience, and three members must be public members representing the general consumer base.
The Trap
Candidates frequently confuse the purpose of TREC. TREC does not represent real estate professionals, negotiate commission rates, or settle agent commissions. Its primary purpose is strictly consumer protection, and commission disputes are settled in court or via local Realtor boards.

An agent in Waco is accused of misleading an elderly home seller about the market value of their property. The consumer files a formal complaint with TREC. TREC has the authority to investigate the agent, hold a hearing, and suspend or revoke the agent’s license under TREC Rules.
