Promulgated Form
Promulgated forms are legally binding templates developed to protect consumers and standardize transactions. By using these forms, Texas agents avoid drafted legal contract language, which would constitute the unauthorized practice of law.
Texas-Specific Nuance & Citation
Under TREC Rule §537.11, real estate license holders are legally required to use contract forms promulgated by TREC for the specific transaction type, unless an exception applies (such as a form prepared by the property owner or an attorney).
The Trap
A key exam trap is listing agreements. TREC does not promulgate listing agreements or buyer representation agreements. These forms are typically created by local boards or the Texas Association of Realtors (TAR), not TREC.
Worked Example
A sales agent is drafting an offer on a home in Fort Worth. Instead of writing custom contract clauses on a blank sheet of paper, the agent must use the TREC promulgated “One to Four Family Residential Contract (Resale)” and fill in only the blanks. Adding complex legal contingencies in standard blank fields could violate state law.
